Edo politician and lawmaker, Hon Washington Osifo,PHD has dragged the Attorney General of the Federation and Minister of Justice, the Senate, the Minister of Niger Delta Affairs, Godswill Akpabio , the NDDC and the Sole Administrator of NDDC , Effion Akwa before a Federal High Court sitting in Benin City over the present composition of the NDDC governing board.
The plaintiff, Hon Washington Osifo is asking the court to interpret the constitutionality of the sacking of the Governing board of the Niger Delta Development Commission,NDDC, and the subsequent appointment of a sole administrator by the President of the Federal Republic of Nigeria or any of its agencies acting on its behalf.
The plaintiff is also seeking to know if it is constitutional for the FG to appoint a sole administrator as against the establishment act of the NDDC and lastly if the Senate can approve budgetary allocation to NDDC in the absence of a properly constituted board of the NDDC.
Recall that President Buhari sometime ago sacked the governing board of the NDDC and subsequently appointed a sole administrator in the person of Effion Akwa.
This lawsuit is set to determine a few fundamental issues on the eligibility of administrating the NDDC without a duly composed governing board for the Niger Delta Development Commission.
The plaintiff who is from an oil-producing state,Edo State is praying the court stops the fifth defendant or any individual from running the affairs of the NDDC without a properly constituted governing board.
Hon Washington is also praying the court stops Effion Akwa from parading himself as the sole administrator of the NDDC which position is unknown to the law establishing the NDDC.
He also requested the Senate should be barred from approving any budgetary allocation for the NDDC under Effion Akwa.
